The Children

Your children are the most important part of the whole process of splitting up. The strain put on parents because of contact arrangements or the lack of them is one of the things that we hear most about.

In Scotland the Law on Children is largely to be found in the Children ( Scotland ) Act 1995. This Act introduced into the Law of Scotland the concept of Parental responsibilities and rights. Most Family based disputes are in relation to the parental rights of Residence (formerly known as Custody) and Contact (formerly known as access) The overarching principle in this area of the Law is the Welfare Principle.
