Financial issues are mainly dealt with on Divorce under the Family Law ( Scotland) Act 1985. The Act provides that the net value of the matrimonial property at the relevant date is to be divided between the parties. This division is made by application of what are known as the "s9 Principles". Where a spouse applies for a financial order the court can award a Capital sum, a transfer of property order, a periodical allowance, as well as a share in a pension, and/or maintenance.
