You may not want to think about it, but you
now need to think about how you, and any children of the
marriage will be affected by the divorce.
Will you be able to
stay in the same house?
Will the children go to the same
school?
How will you manage
financially if you cannot return to work?
We have experience with these and whole lot of
other financial issues so contact us and let us advise you on
how to make the best of your situation.
Financial issues
are mainly dealt with on Divorce under the Family Law (
Scotland) Act 1985. The Act provides that the net value of the
matrimonial property at the relevant date
is to be divided between the parties. This division is
made by application of what are known as the "s9
Principles". Where a spouse applies for a
financial order the court can award a Capital sum, a transfer
of property order, a periodical allowance, as well as a share
in a pension, and/or maintenance.
